EU Court Says Kit Kat Shape Can’t Be Trademarked

(Brussels) — Nestle’s 16-year legal battle to trademark the shape of the Kit Kat candy bar in Europe is ending with a loss. Nestle had tried to trademark the shape of the four-fingered bar to prevent others from copying it. The EU’s highest court said the Kit Kat bar isn’t distinctive enough to warrant a trademark of the design.
